Our personal injury claims law services.

Cosmetic procedures claims

When we undergo a procedure, we depend on medical professionals to make decisions and take actions not only in our best interest, but informed by a reasonable expectation of skill and care. Sometimes, unfortunately, we are let down.

Our cosmetic surgery claims solicitors offer effective and easy-to-understand legal advice to help clients who have had cosmetic surgery go wrong. You may have been misinformed about the risks of your procedure, were not given correct aftercare, were treated with a defective product, or the procedure failed to meet standards. However you were let down, we can help you seek compensation.

Catastrophic, spinal and brain injury claims and fatal accidents

Given the potential severity of a spine and brain injury, these are almost exclusively high-value claims and so require a high level of expertise. Likewise, a fatal accident requires an immediate legal response on behalf of the deceased individual’s family.

Our catastrophic, spinal and brain injury claims and fatal accident lawyers are positioned to secure critical accident compensation to provide for a loss of income and ongoing expenses, such as medical treatment, the assistance of professionals, care requirements, equipment and accommodation. Equally, we can also support you in claiming compensation which accounts for a loss of amenity (a loss of quality of life and lifestyle changes), or accounts for your loss in fatal accident cases.

Dental negligence

Malpractice from a dentist can cause you unnecessary pain and suffering, and can even lead to you needing further, more extensive and expensive treatment. Our dental negligence lawyers can help you to seek financial reparation for your struggle.

Highways claims

Those entrusted with maintaining the highway owe a degree of responsibility for injuries sustained due to poor-quality roads. Whether you were walking, cycling, or driving, if your accident was caused by a defect in the road surface such as a pothole, or by the failure of the authorities to warn you of a hazard, for example, snow or ice, then one of our highway claims lawyers may be able to help you to seek compensation.

Industrial disease claims

Industrial diseases can be caused by poor workplace conditions or inappropriate materials. This could include asbestos-related diseases, such as asbestosis, mesothelioma, pneumoconiosis and silicosis from exposure to dust particles, including coal, silica, or metal dust, other forms of industrial asthma caused by fumes and artificial stones, and other workplace-caused diseases.

Our industrial disease claims lawyers can help you communicate with the party that risked your well-being, putting together a strong case to support your claim. This will include collating the medical records pertaining to your injury and further evidence from medical experts, as well as seeking fair and favourable financial compensation to aid in your recovery and health.

Injuries to members of the Armed Services

As a firm with its head office in the historic naval town of Portsmouth, we proudly represent individuals who suffered an injury during their military service. Our specialist military injury claim lawyers have a wealth of experience and are experts in military law, having been assisting servicemen and servicewomen for over 60 years.

Landlord and tenant claims

Landlord and tenant-specific injuries can come about when landlords and local authorities/housing associations neglect to maintain your living space, leading to you suffering from an injury or loss of health.

Neglect and poor maintenance in properties can lead to health issues such as lung diseases caused by deficient air quality or injuries caused by collapsing, derelict walls and fittings. Contact our landlord and tenant claim lawyers to find out if you have grounds to make a claim and what your options are.

Occupational illness

Occupational illness is a health category that covers any injuries or conditions caused by non-instantaneous events or repeat work conditions. For example, if you have suffered from noise-induced deafness claims, stress-related claims, vibration white finger or repetitive strain injuries (RSIs), then you should reach out to one of our occupational illness claims lawyers.

To put together a compelling occupational illness claim, your personal injury lawyer will collect medical records and evidence to clearly demonstrate that your workplace exposure caused your persistent injuries.

Occupiers liability

Our team of occupiers liability lawyers are concerned with seeking compensation for injuries that you sustained due to the owner of a premises having mismanaged the location until it became unsafe and directly led to your injury. Examples of this include slipping on an unmarked wet floor at a supermarket or a poorly indicated step, causing you to trip.

Product liability

If you have been injured by a defective product, then reach out to one of our product liability claim lawyers, and we will assess your experience and determine whether you have a claim.

Examples of a product liability claim could include a poorly designed product that makes it inherently dangerous, such as machinery that does not come with effective safety precautions, or defective products, such as a gas boiler causing carbon monoxide poisoning.

Professional negligence

If the injury you sustained was caused by a professional, such as a lawyer, accountant, financial advisor, architect, or surveyor, then you may be able to make a professional negligence claim.

One of our professional negligence and personal injury lawyers in Hampshire and the Isle of Wight can use their regional connections to local professionals to ascertain what would be considered a reasonable duty of care and professional standard of expertise and subsequently build a claim proving how the defendant fell short in your experience with them.

Road traffic accidents

At Biscoes, we have one of the most experienced road traffic accident departments in the South.  Our road traffic accident claims lawyers can help you if your injury is related to any form of road traffic. The sorts of accidents that can occur when you are either driving or affected by someone else who was driving can range from fairly standard procedures to devastating. Whether you were a pedestrian or operating a vehicle, Biscoes’ team of injury claim lawyers can help, regardless of your insurance status.

Military hearing loss claims

Our military injuries team frequently represent clients who have suffered deafness, tinnitus and other hearing loss or impairment related injuries from their jobs in the armed forces. We can put together evidence towards how your role directly led to the injury, including medical records, witness statements and reports from trusted third parties, and will assist you in obtaining the compensation you are owed.

Motorcycle accidents

Our motorcycle accident claims lawyers can assess your case and help to pursue the maximum compensation available to you in the form of reparations for your injury and necessary rehabilitation, as well as funding for replacing damaged protective gear and bike repair.

Sports injuries

Whether you were a participant in the sport or a spectator, if you have sustained a personal injury during an organised event, you may be able to claim compensation.  Our sports injury lawyers will work with you to prove how the sporting activity led to your injury and where responsibility ultimately lies. For example, it could be due to faulty equipment, poor oversight by referees or organisers, or deliberate harm caused by another player.

Travel claims

Travel injury law is notoriously tricky. Claims require an expert command of the Package Travel, Package Holidays and Package Regulations of 1992, as well as training in specialist research into the region-specific duties of care. Our travel claims lawyers have decades of experience in managing such claims with high rates of success.

Workplace accidents

There are several situations that could lead to a workplace accident claim, which can make it more difficult to identify and come forward when you feel you have been affected. This could involve exposure to harmful chemicals, repetitive motion injuries, slips and trips, falls, or other occupational hazards that you were exposed to whilst at work. This trickiness is compounded if you are still relying on your employment from the workplace in question.

Our specialist workplace accident lawyers are trained to identify situations which would qualify you for compensation, so if you aren’t sure, please speak to us.

Funding a claim

There are four main ways to fund your personal injury claim. When you work with our personal injury lawyers, they will discuss the funding options available to you, helping you to peruse and secure one of the following:

Frequently asked questions about our personal injury claims services

How long do I have to make a personal injury claim?

In the majority of cases, you have three years from the day that the injury occurred to make your claim, or three years from the day that you would be reasonably expected to be aware that you were injured.

There are some exceptions to this general rule. For example:

  • If the injured individual lacks sufficient mental capacity to make a claim, there are no time limits for someone to make a claim on their behalf.
  • If the injured individual was under the age of 18 at the time of their injury, a claim can be made at any point before their 18th birthday. After this point, they will have until they turn 21 to make a claim.

Our personal injury lawyers will be available to provide tailored guidance on the time limits that will apply in your circumstances.

What happens if I was partly responsible for the injury?

If you were partly at fault for the accident, then you may still be able to make a claim, but due to your share of the responsibility (known as “contributory negligence”), the financial amount you receive will likely be reduced in portion.

How long does a personal injury claim take to settle?

The duration of your case will depend on the complexity of your claim. Simple cases resolved through negotiation may take a few months, whilst complicated and court-demanding cases can take years to resolve.
