When a couple separates, those with children also need to consider the arrangements for the children.

The family team at Biscoes understands the stresses and emotions connected to this and the difficulties in trying to manage the potential impact of the separation on the arrangements for the children.

A desired outcome is for the parents to be able to reach an agreement and effectively co-parent; however, this is not always possible.

In some cases, you may require the court to help you reach an agreement or make a decision for you. The court will try to encourage you, as the parents of the children, to reach an agreement as you know them best. This could encourage further agreements being reached in the future, avoiding the need for the court to intervene further. The arrangements can be recorded in a Child Arrangements Order, setting out where a child lives and what time they spend with each parent (previously called residence and contact).

At all times, the court will consider what is in the best interests of the children and treat their welfare as most important.

When it comes to matters involving children, we understand that it is not always about the parents - you may be a grandparent or another family member wanting to understand your position in respect of the children of the family.

The arrangements for the children also cover other important aspects of life for the children, for example:

  • Which school should they attend?
  • Should their names be changed?
  • Should they receive medical treatment if the other parent won’t agree?
  • Should they go on holiday with one parent whilst the other doesn’t consent?
